Waiver
Release and Waiver of Liability and Assumption of Risk Agreement:
All role dates
I hereby acknowledge and agree that in consideration of being permitted to participate or volunteer in the RBC GranFondo Whistler (herein called the cycling event) operated by TOIT Events Inc. (herein called TOIT):
1. I do hereby release TOIT, its owners, employees, sponsors, independent contractors and agents from all liability, and do hereby waive as against TOIT, its owners, employees, sponsors, independent contractors and agents all recourses, proceedings, claims, and causes of action of any kind whatsoever, in respect of all personal injuries or property losses which I may suffer arising out of or connected with my preparation for, or participation in, the cycling event, notwithstanding that such injuries or losses may have been caused solely or partly by the negligence of TOIT, or any of their members, officers, directors, employees, independent contractors or agencies,
2. And, I hereby acknowledge and agree:
- That the sport of cycling is very dangerous, exposing participants to many risks and hazards, some of which are inherent in the very nature of the sport itself, others which result from human error and negligence on the part of the persons involved in preparing, organizing and staging cycling event;
- That, as a result of the aforesaid risks and hazards, I as a participant may suffer serious personal injury, even death, as well as property loss;
- That some of the aforesaid risks and hazards are foreseeable, but others are not;
- That I nevertheless freely and voluntarily assume all the aforesaid risks and hazards, and that, accordingly, my preparation for, and participation in the cycling event shall be entirely at my own risk;
- That I understand that neither TOIT nor any of its owners, employees, sponsors, independent contractors or agents assume any responsibility whatsoever for my safety during the course of my preparation for or participation in the cycling event;
- That I have carefully read this RELEASE and WAIVER of LIABILITY AND ASSUMPTION of RISK AGREEMENT, that I fully understand same, and that I am freely and voluntarily executing same;
- That should I opt to hand over any property to TOIT that I will not hold TOIT, its owners, employees, sponsors, independent contractors and agents responsible for any loss or damage to that property;
- To allow TOIT the use of my image or likeness during participation in the cycling event for the purpose of promotion;
- That I understand clearly that by signing this Agreement I will be forever prevented from suing or otherwise claiming against TOIT, its owners, employees, sponsors, independent contractors and agents for any loss or damage connected with any property loss or personal injury that I may sustain while participating in or preparing for the cycling event, whether or not such loss or injury is caused solely or partly by the NEGLIGENCE of TOIT or any of its owners, employees, sponsors, independent contractors and agents;
- That I have been given the opportunity and have been encouraged to seek independent legal advice prior to signing this Agreement;
- That I understand clearly that TOIT would not permit me to participate in the cycling event unless I signed this RELEASE and WAIVER of LIABILITY AND ASSUMPTION of RISK AGREEMENT, that RELEASE and WAIVER of LIABILITY AND ASSUMPTION of RISK AGREEMENT applies to the cycling event whether occurring in the near or distant future, and that the terms of this Agreement need not be brought to my attention each time I participate in the RBC GranFondo Whistler in order to be effective;
- That this RELEASE and WAIVER of LIABILITY AND ASSUMPTION of RISK AGREEMENT is binding on myself, my heirs, my executors, administrators, personal representatives and assigns;
- I recognize that this Agreement may be in addition to another agreement I must sign as a condition of participation and that I am bound by the terms and conditions of both agreements.
- I agree that I am physically capable of participating in the cycling event, and that I have no pre-existing conditions that would hinder my ability to participate in the RBC GranFondo Whistler.

MINOR VOLUNTEER RELEASE AND WAIVER OF LIABILITY FORM
PLEASE READ THIS LEGAL DOCUMENT THAT AFFECTS YOUR LEGAL RIGHTS CAREFULLY.
Dear Parent or Guardian,
We are excited about your child/dependent’s interest in volunteering for TOIT Events Inc. 's 2023 RBC GranFondo Whistler event! Prior to the commencement of volunteer duties with TOIT Events Inc., this form must be filled out. It is the registrant's responsibility to update/notify Kerri, TOIT Events Inc.’s Volunteer and Crew Manager, of any changes to the information detailed by this form. Please note that TOIT Events Inc. abides by the BC Privacy Legislation Guidelines and is committed to respecting the privacy of our volunteers.
Please review and understand the following:
1) I understand that the minimum age of a volunteer is 15 and that all volunteers between the age of 15 and 17 must have parental/guardian consent in order to volunteer.
2) I accept the responsibility for my child/dependent’s security and safety, and personally undertake to have my dependent/child act in both a safe and responsible manner while adhering to the volunteer code of conduct.
3) Code of Conduct: As a volunteer for TOIT Events Inc.:
• I will work to fully understand my role and actively engage with staff, fellow volunteers and the community
• I will treat others around me with kindness, dignity and respect
• I will notify my supervisor or department/volunteer manager of any changes to my information or health • I understand that volunteering for TOIT Events Inc, is voluntary. I also understand that, as with any task, there may be a degree of risk in undertaking certain tasks. After carefully considering the risks involved, I will take reasonable precautions to ensure my own individual safety.
4) Confidentiality Agreement: As a part of your volunteer work, you may come into contact with information of a sensitive nature. This Agreement is intended to inform you of private and protected information so you can assist us in upholding the confidentiality of information within our organization. The information that follows may include confidential information of TOIT Events Inc.:
• Information concerning the business and operation of TOIT Events Inc., including written, verbal, and electronic communication.
• Customer, client, sponsor, volunteer, and organization information (name, address, phone number, company, etc.).
5) Awareness of Risks: I, the parent/guardian of the undersigned child (the “Child”), desire to have the Child participate as a volunteer for the TOIT Events Inc.’s 2023 RBC GranFondo Whistler event in full knowledge and understanding of the risks associated with the Child’s participation as a volunteer for TOIT Events Inc. and now freely accept and assume such risks which include, without limitation, risk of minor or major bodily injury (including death), damage or theft to property or other loss or damage arising out a variety of dangers and hazards such as overexertion, dehydration, fatigue, lack of fitness or conditioning, traumatic injury, defective, dangerous or unsafe condition of facilities or equipment, falls, collisions with objects, walls, equipment or persons and negligence or other acts or omissions of TOIT Events Inc employees, agents, other volunteers, invitees or users of TOIT Events Inc. facilities. I, the undersigned Child, am aware of and now freely accept and assume the risks associated with my participation as a volunteer for TOIT Events Inc.

CONSENT FORM: RBC GranFondo Whistler 2023 Volunteers Under the Age of 18 Years Old
I, being the parent and/or legal guardian of the “Minor” hereby consent to and authorize the Minor to act as a volunteer for TOIT Events Inc.’s (the “Organization”) 2023 RBC GranFondo Whistler event. I both agree and acknowledge that activities performed by the Minor as a volunteer will be performed strictly on a voluntary basis, without any pay, compensation, or benefits. I agree and understand that the Minor must comply with the rules and regulations established from time to time by TOIT Events Inc. and that failure to do so may result in the Minor’s immediate removal as a volunteer.
I am aware of the nature of the activities to be performed by the Minor as a volunteer and recognize that in performing volunteer tasks, a risk of harm or injury exists. I agree that all volunteer activities are to be performed by the Minor at the Minor’s risk and I assume full responsibility therefore.
On behalf of myself, the Minor, and our respective heirs and personal representatives, I agree not to hold or attempt to hold TOIT Events Inc. their population served, volunteers, or staff responsible for any injury or damage sustained or incurred by the Minor, arising out of or in any way connected with the Minor’s activities as a volunteer for TOIT Events Inc. I hereby release and discharge TOIT Events Inc., their employees, and their volunteers from any and all claims, demands, causes of action of any nature or cause, for any such injury or damage incurred or suffered by the Minor.
